ORDER OF THE BOARD (by Mr. Goodman):

This matter comes before the Pollution Control Board

(Board) upon the October 27, 1975, motion of Central Illinois

Light Company (CILCO) to dismiss the complaint herein.

The Board finds that the facts as alleged in the Complaint

are sufficient to state a cause of action under Procedural

Rule 304(c) (2) and Section 12(b) of the Environmental Protec-

tion Act, and Rule 951(a) of the Water Regulatio-’.

Therefore it is the Order of the Board that said motion

be and is, hereby, denied.
