OPINION AND ORDER OF THE BOARD (by Mr. Goodman):
This matter comes before the Pollution Control Board
(Board) upon the May 30, 1975 variance petition of Chrysler
Corporation (Chrysleri for its Belvidere, Illinois, Assembly
Plant from Rule 205(f) of the Air Pollution Regulations.
The Environmental ~rotection Agency (Agency) filed its
recommendation that the variance be denied on July 14, 1975.
Chrysler seeks a variance until July 1, 1975, from Rule
205(f) for its autor~obilebody prime spraying and baking
operations. Compliance would result through the use of non-
photochemically reactive solvents as defined in Rule 201.
Chrysler, however, has failed to describe the exact solvents
it intends to use in order to achieve compliance.
Chrysler has been attempting to comply through the use
of aqueous based materials thereby coming within the
205(f) (2) (D) exemption. However this plan of compliance
would not be feasi~le for an additional two years. On the
basis of complianc9 by May 30, 1975, through 205(f)(2)(D),
the Agency granted Petitioner an Operating Permit on Septem-
ber 4, 1974.
In addition to the absence of information concerning
the chemical composition of the proposed non—photochemically
reactive solvents, Chrysler has not stated the hardship
which would result from compliance with Rule 205.
It is the Opinion of the Board that Chrysler’s variance
petition is insufficient and must be dismissed.
This Opinion ~onstitutes the Board’s findings of fact
and conclusions of law in this matter.
ORDER
It is the Order of the Board that Chrysler Corpor-
ation’s petition for ~iriance from Rule 205(f) be and is
hereby dismissed without prejudice.
