matter comes before the Pollution Control Board

(Board) upon Petitioner’s motion to modify an Order of the

Board entered herein on October 17, 1972 and supplemented

October 24, 1972. Petitioner specifically requested that

its petition be considered as a post hearing motion rather

than a petition for variance.

It is the Order of the Board that:

a) the June 2, 1975, petition be considered as a post-

hearing motion; and

b) the June 2, 1975, post-hearing motion be and is

hereby denied as being untimely.
