INTERIM
ORDER
OF THE
BOARD
(by Mr. Dumelle):
The
Board finds that Union Hill Homeowner’s Association
(Union
Hill)
has
not
heretofore
been
properly joined as a party
respondent in the above captioned cause in conformance with the
August 7, 1975 Interim Order of the Board.
However,
for the
reasons stated in that Interim Order, Union Hill must be joined
as a party respondent in this matter.
Therefore, subject to
proper service of process, Union Hill is joined as a
party respondent to the above captioned cause.
This cause is
remanded to the Hearing Officer in the above captioned
cause for further hearings to be held within 60 days of the date
on which the Clerk of this Board receives, as proof of service,
a registered mail receipt properly executed by the registered
agent for Union Hill or its authorized agent.
Respondent Kamarasy’s Motion to Bring In Third Party
Respondent is denied.
This Board is charged with protecting
the environment of the State of Illinois,
and not with adjudicating
the rights of one respondent as against another.
IT IS SO ORDERED.
