INTERIM ORDER OF THE BOARD (by Mr. Zeitlin):
The Regulatory Petition filed March 3, 1976 by Central Illinois
Public Service Company concerning a “lake” to be constructed in
conjunction with its Newton, Jasper County power station is deficient
in several respects:
1. No Regulation is proposed. Rule 203(i) (10)
of Chapter 3: Water Pollution sets out a procedure
for the proposal of specific temperature standards
for individual bodies of water, and the approval of
such an individual standard by the Board; the March 3,
1976 Petition nowhere mentions such an individual
standard.
2. No showing is made that Rule 203(i) (10)
will even be applicable to the “lake” mentioned in
the Petition. Petitioner merely states that a “lake”
is to be constructed, but discussed the possible
application of (1) Environmental Protection Agency
permitting, vis—a-vis a wastewater treatment works,
and (2) Rule 203 (i) (10), which concerns water quality
standards for “artificial cooling lakes,” which are
to be distinguished from “treatment works,” as in the
case of a “side-channel” or “perched” lake used for
cooling purposes. See, In the Matter of Water Quality

3. No statement of need accompanied the Petition
as submitted. Board Procedural Rule 203 requires such
a statement.
The Board shall determine whether to authorize a hearing on this
matter, under Procedural Rule 204, upon correction of the above defi-
ciencies. Failure to correct those deficiencies within 30 days shall
cause the Petition to be dismissed for inadequacy under Procedural Rule
204.
