    ORDER OF THE BOARD
    (by Dr.
    Satchell):
    The Petition filed March
    2,
    1976
    is inadequate in that:
    (1)
    data showing the nature and extent of the present
    failure to meet the particular provisions from
    which the variance is sought are not provided.
    (2)
    the classification of land external to the property
    is not given.
    (From your exhibit it would be
    assumed to be Class A, Code 11 through 19
    -
    Household Units and similar, unless otherwise shown).
    (3)
    it is not clear whether operations are conducted
    during both daytime and nighttime hours.
    (4)
    while it may be true that present technology does
    not permit the purchase of lined or wrapped chutes
    to adequately attenuate the noise of grain entering
    and moving within the chutes from the headhouse to
    storage,
    this would not appear to exhaust the
    possibilities of abatement.
    This leaves the Petition inadequate with regard to a
    plan and time schedule for compliance.
    Petitioner shall amend the Petition within 45 days from
    the date of this Order to provide the needed information.
    The 90-day period set by statute for a decision shall run

    from the filing of the amended Petition.
    Failure to
    timely file the amended Petition shall make it liable
    to dismissal for inadequacy.
