ORDER OF THE BOARD

This matter comes before the Pollution Control Board

(Board)

upon Petitioner’s March

2,

1976,

motion

to modify the final Order,

herein,

issued February 26,

1976.

No response has been received from

the Environmental Protection Agency.

The Board will grant the relief

requested.

Petitioner correctly contends that the Hearing Officer,

herein, allowed

it to amend its petition to include permit 1975-SA-

1047 COP for operation of a project on Sector

3 of the former United

Electric Property.

Special Condition

#8 contains the same language

as Special Condition #11 and,

for the same reasons stated in

the

February

26 Opinion, will be struck from said permit.

This Opinion constitutes

the Board’s findings of fact and conclu-

sions of law

in this matter.

ORDER

It

is the Order of the Board that Special Condition

#8 be and

is,

hereby,

deleted from permit #1975-SA-1047-COP.

IT IS SO ORDERED.
