because the United States Environmental Protection Agency did

through December 31, 1999.

(1998)), and accepted a stipulation and settlement agreement in
this Resource Conservation and Recovery Act enforcement action
concerning a facility located in Knox County, Illinois, ordered the
respondent to pay a civil penalty of $173,000, and to cease and
desist from further violations.

petitioner’s steel building is a “pollution control facility” under the
