OPINION
AND
ORDER OF THE BOARD
(by Mr.
Goodman):
This matter comes before the Board upon Petition for variance
by Intercontinental Alloys Corporation
(Intercontinental)
requesting
relief from Rule 203(a)
of the Air Pollution Control Regulations
until installation of the air pollution control equipment in Inter-
continental’s facility located near Crest Hill, Will County.
Intercontinental was granted a variance from Rule 203(a)
of the
Regulations for their two aluminum melting reverberatory furnaces
until January
1, 1976
(PCB 74—432).
Under this variance Interconti-
nental was to have installed hooding ducts and blowers to collect
and incinerate particulate emissions generated during charging and
to have converted to the “Derham Process” to reduce emissions gene-
rated during chlorination.
Petitioner alleges that it has incurred
delays in implementing a compliance program and therefore seeks
an
extension of its variance until June 30,
1976 for furnace
*2 and
until September 1,
1976 for furnace
#1.
Agency investigation indicates that design problems and scar-
city of materials are the cause of Petitioner’s delay
in completing
their compliance schedule.
At this time furnace
#2 is being modi-
fied and is expected to be fully controlled by March 31,
1976.
It
is expected that a 30-90 day testing and debugging period will be
necessary to initiate the
“Derham
Process”.
The Agency
in their
recommendation points out that since furnace
#1 will be shutdown
upon completion of the modifications of furnace
#2, the facility
should be in compliance with Rule 203(a) by June 30,
1976 at the
latest.

In 1975 the average geometric mean for total suspended particu-
lates at the Joliet Rivals Park monitoring station located approxi-
mately two miles south of Petitioner’s facility was
77 ug/m3.
Although this is slightly above the national primary ambient air
quality standard of 75 ug/m3,
the Board does not find so small
a
variance from the standard to be determinative in this case.
The Agency,
finding satisfactory progress to have been shown
and that compliance
is imminent, recommends Intercontinental be
granted variance from Rule
203(a)
until June 30,
1976 subject to
certain conditions.
Upon review of the record the Board agrees with
the Agency recommendation and will grant Intercontinental variance
from Rule 203(a)
until June
30,
1976.
This Opinion constitutes the finding of fact and conclusions
of law of the Board in this matter.
Mr. Dumelle dissented.
ORDER
It
is the Order of the Pollution Control Board that:
Intercontinental Alloys Corporation be granted variance from
Rule 203(a)
until June
30,
1976 subject to the following conditions:
(a)
Petitioner shall continue submitting monthly reports
to the Agency detailing progress made toward final
compliance with Rule 203 (a).
(b)
Within 90 days of this Order Petitioner shall obtain
all necessary construction permits from the Agency.
(c)
Within
90 days of the completion of installation of
the control equipment for each furnace, Petitioner
shall obtain all necessary operating permits from the
Agency.
(d)
Within
45 days of the completion of installation of
the control equipment for each furnace, Petitioner
shall have a particulate stack test conducted on that
furnace using procedures described in U.S. EPA Method
5 by an approved independent testing company.
Petitioner
shall notify the Agency
in writing at least 10 days
prior to the testing and shall allow Agency personnel

to witness all tests and review all results.

(e)
Within
35 days of the Boardts final Order herein,
Petitioner shall execute and forward to the Control
Program Coordinator,
a Certification of Acceptance
and agreement to be bound to all terms and conditions
of the variance.
The form of said Certification shall
be as follows:
