ORDER OF THE BOARD (by C.A. Manning):
On February 3, 1997 the Central Illinois Public Service Company (CIPS) filed a
petition for a variance from the current thermal standards for Coffeen Lake granted in PCB 77-
158. CIPS’ petition is deficient as it fails to contain information required by 35 Ill. Adm.
Code 104.121(a) and 104.121(e). Section 104.121(a) requires CIPS to provide a clear and
complete statement of the extent of the relief requested and to identify the regulations from
which relief is sought. Section 104.121(e) requires CIPS to provide data describing the extent
and the nature of the present failure to meet numerical standards or particular provisions from
which the variance is sought. CIPS has requested that the Board incorporate the opinion and
order in PCB 77-158 when considering its petition for variance. The Board shall incorporate
by reference the opinion and order in PCB 77-158; however, in accordance with 35 Ill. Adm.
Code 101.106, CIPS shall provide the Board with copies of any other documents it deems
necessary to evaluate its petition for variance.
CIPS is directed to file an amended petition on or before March 24, 1997. If the
amended petition curing these deficiencies is not filed within 45 days of the date of this order,
this petition will be subject to dismissal. The filing of an amended petition will restart the
Board’s decision timeclock pursuant to Section 38(a) of the Environmental Protection Act.
