INTERIM ORDER OF THE BOARD (by Mr. Zeitlin):
On November 16, 1976, Petitioner Del Monte Corporation filed
a Motion for Protective Order, asking that its entire permit appli-
cation be deemed confidential, and not subject to disclosure. On
December 2, 1976, the Board entered an Order finding that application
inadequate under Procedural Rule 107, and allowing amendment of
Petitioner’s application for non—disclosure.
On December 15, 1976, Petitioner filed an amended application
for non—disclosure, requesting action on that application prior to
a January 4, 1977 hearing. Inasmuch as the Board has not had suffi-
cient time to review that application, and inasmuch as Petitioner
has filed a 42—day waiver of the statutory 90—day decision period,
we shall on our own Motion order that the January 4, 1977 hearing
be continued by the Hearing Officer to a date subsequent to the
Board’s January 6, 1977 meeting, at which time the amended applica-
tion for non—disclosure shall be considered.
