    OPINION AND ORDER OF THE BOARD (by Mr.

    Petition for Variance from Rule 404 (f) (ii) of the Water
    Pollution Regulations was filed with the Board on September 2, 1976.
    On September 15, 1976 the Board ordered that an Amended Petition be
    filed incorporating prior Variance Petitions and proceedings. This
    was done on September 21, 1976. No public hearing was held.
    It appears that the subject facility, the Gurnee Sewage Treat-
    ment Plant, falls under the exemptions of the new Rule
    409
    of the
    Water Pollution Regulations. This Rule was adopted by the Board in
    R75—15 on September 30, 1976 and became effective on October 13,
    1976. The proceeding is thus moot and is dismissed.
