CONCURRING OPINION (by Mr. Dumelle):
My reason for concurring is that no satisfactory explanation
appears in the record for the discrepancy between the stack data
submitted by Hyon and the permit limits now being requested by
Hyon.
What the Agency seems to have done in this case was to fully
incorporate into the permit those levels (and the burning rate) of
pollutants found by Hyon in its actual tests. Now Hyon has protested
the resulting permit conditions. But why were the stack tests not
performed at the burning rates testified to by Hyon as being the
minimum
for economic operation? And what would be the concentration
of pollutants in the waste gases at the higher burning rate?
We are dealing here with relatively new technology. It is
a necessary technology since many industrial wastes are best
permanently disposed of by incineration. But we must make certain
that dangerous metals or other substances are not released in
quantities so as to harm persons or the environment.
