ORDER OF THE BOARD
(by Mr. Young):
On December
2,
1976, Clark submitted to this Board a
Motion for Reconsideration
of our Opinion and Order in this
matter.
Attached to that Motion is an affidavit of Robert
H.
Bruggirik in which he states that Clark presently has an
operating permit and that this permit was issued without
any additional equipment having been installed.
The affidavit
fails
to inform the Board however relative
to the fact whether
any exchange of information has occurred between Clark and the
Agency since the last hearing in this matter, and whether
this
exchange, if one occurred, accounts for the apparent change
in the Agency position on the permit.
Before
the
Board rules
on this Motion, the parties will be allowed
28 days
in which
to submit affidavits clarifyinq these issues.
