INTERIM ORDER OF THE BOARD

Dumelle):
On May
19, 1976 the Agency received and forwarded to this
Board a letter from the developers who own the lots which are the
subject of the Village of Dupo’s Petition for Variance.
In that
letter Elmer and Marian
Schlenurier noted their desire for a public
hearing and previous letters requesting an opportunity to present
their position.
The Board finds that in accordance with Procedural
Rule 405
a hearing is necessary in this matter.
Due to the time required for public notice and the late
submission of the Schlemmer’s letter such a hearing could not be
scheduled without a further 30-day waiver by the Village of
Dupo of its right to a decision within 90-days of the filing
of its petition.
The Board’s decision to hold a hearing in this
matter is hereby expressly conditioned upon receipt of such a
waiver from the Village of Dupo.
Further, due to the nature and extent of the Schlemmer4s
interest in this proceeding the Board hereby joins Elmer and
Marian Schiemmer as parties to this proceeding.
