The decision of the Supreme Court in Commonwealth Edison

v.

PCB, Supreme Court Docket No.

47352

1976), may affect

this proceeding.

Without ruling on the merits of the appeal,

the

Board believes that the resolution of this matter may be greatly

expedited by the resubmission of a permit application for Agency

consideration thereof.

The Board would be willing to entertain a motion of

U.S.

Tobacco staying the permit denial appeal pending Agency consideration

of a permit application.
