SUPPLEMENTAL STATEMENT
(by Mr. Dumelle):
The Board opinion recognizes
a serious “erosion problem”
(p.4)
on Mr. Tarkowski’s property but seems to dismiss his stated use of
the landscape wastes berm as
a “silt dam”.
Brush
is
commonly used to prevent erosion
in gullies.
The
terrain here seems
to be
flat.
If a “silt dam”
300 feet
in length
is actually needed,
then the erosion must be the result of overland
or sheet
flow.
The record does not seem to be clear on the entire “erosion
problem” and its solution.
I am concerned that the Board’s decision
in ordering the removal of the landscape wastes may be exclusively
because of fire hazard possibilities and thus may preclude use of
brush, where warranted,
as a low cost method of preventing erosion.
