of granting the proposed variance upon the receiving stream is not

given.

Petitioner shall describe the present and future condition

of the stream as to dissolved oxygen levels, odors, bottom sludge

deposits, algae,

and any other indications of degradation in an

Amended Petition to be filed within

45 days from the date of this

Order with both the Board and the Agency.

A waiver of the 90-day period set by statute for decision shall

also be executed to run from the date of filing the Amended Petition.

Failure to timely file the Amended Petition shall render this

cause liable to dismissal for inadequacy.
