ORDER OF THE BOARD (by Mr. Young):
On July 22, 1976, the Atlas Building Company and the City
of Peru filed a petition for variance with the Board. The
petition is inadequate in that it does not contain any informa-
tion relative to the frequency, severity and duration of the
overflows. Furthermore, the petition does not contain any in-
formation relative to the dry weather performance of the collection
system.
It is the Order of the Board that Petitioners shall amend
the petition within 45 days of this Order. Failure to timely file
an ame.nded petition shall cause the petition to be denied without
prejudice for inadequacy. The 90—day decision period set by
Section 38 of the Environmental Protection Act shall run from the
date of the filing of the amended petition.
