    In the Agency’s r~1otion to Dismiss and in Complainant’s
    Response to the Motion,
    the issue has been raised whether
    Aurora Iron and Metal Company has executed and returned to
    the Agency the required Certificate of Acceptance.
    The Board will allow the parties until August
    9, 1976,
    to submit to the Board affidavits relative to the status of
    the construction permit.
