the Board entered an Order proposinu

a procedural change to the Board’s
Regulations.
The Board’s reasoning for the amendment to Rule
203(i)
(10)
(cc)
of
Chapter
3:
Water
Pollution
was
set
out
in that
Order.
Although the Board authorized
a 30—day public comment period,
no comments were received on the proposal.
We shall
therefore
adopt the Proposal as published in Environmental Register #145
(dated April
11,
1977)
ORDER
Rule 203(i) (10) (cc)
of Chapter
3: Water Pollution of this
Board’s Rules and Regulations
is amended to read as
follows:
(cc) At an adjudicative hearing, the discharger shall
satisfactorily demonstrate to the Board that the
artificial
cooling
lake
receiving
the
heated effluent
will be environmentally acceptable,
and within the
intent
of the Act, including, but not limited to:
(1)
provision of conditions capable of
supporting shellfish,
fish,
and wild-
life,
and recreational uses consistent
wi
~h
good
management practices,
and
(2)
conLroi
of
the thermal
component
of
the
discharger’s
effluent by
a technologically
feasible and economically reasonable method.
