    ORDER OF THE BOARD (by J. Yi):
    On October 30, 1996 the DeKalb Sanitary District (District) filed a variance petition
    requesting relief from 35 Ill. Adm. Code 304.141, NPDES Effluent Standards, as it relates to
    the effluent limitations for carbonaceous biochemical oxygen demand (CBOD
    5
    ) and total
    suspended solids (TSS) as set forth in 35 Ill. Adm. Code 304.120 for its facility. The District
    waived its right to a hearing and no request for a hearing has been received. On December 2,
    1996 the Illinois Environmental Protection Agency (Agency) filed its recommendation. The
    Agency recommends grant of the requested variance subject to certain conditions.
    On December 23, 1996, the District filed a motion for expedited decision. The District
    states that its facility is currently under going expansion and the requested variance is needed
    in order for the planned expansion to continue on schedule. The District claims that it will
    suffer economic hardship if the Board decision is delayed.
    The Board notes that the District did not provide the Board with a date of when the
    expansion of the facility is dependent on receiving the requested variance relief or when delays
    may occur if the requested variance decision is delayed. However, since no hearing has been
    requested and the District waived hearing the Board will grant the motion for expedited
    decision consistent with the Board's resources. The statutory due date of this case is currently
    February 27, 1997.
