ORDER OF THE BOARD (by J. Theodore Meyer):
On December 23, 1996 Koppers Industries, Inc. (Koppers) filed a joint status report
and waiver of the decision deadline. Koppers states that the parties desire to negotiate a
resolution in this matter and expect to meet soon after a new permit reviewer is assigned to the
case. The parties also agree to waive the Board’s decision deadline from February 3, 1997 to
    May 2, 1997.
On December 24, 1996 the Illinois Environmental Protection Agency (Agency) filed a
Motion to Postpone Filing Answer and Record, stating that the 30-day guideline under 35 Ill.
Adm. Code 103.122(d) is insufficient because the original permit reviewer resigned from the
Agency and the matter is being reassigned. The Agency further stated that, upon
reassignment, a meeting between the parties would be scheduled to discuss various options for
resolution of this appeal. The Agency proposes to file its answer on or before February 3,
1997. The Agency noted that petitioner has no objection to the Agency’s request.
The Board grants the Agency’s motion and directs the Agency to file its answer and the
record on or before February 3, 1997. The Board’s decision due date is now May 2, 1997.
    IT IS SO ORDERED.
    Kathleen M. Hennessey abstained.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, hereby certify that
the above order was adopted on the _____ day of ___________, 1997, by a vote of
    ______________.
