ORDER OF THE BOARD (by J. Theodore Meyer):

This matter comes before the Board on a joint status report and request for extension of

stay filed December 17, 1996 by Abbott Laboratories and the Illinois Environmental

Protection Agency (Agency). The present matter is subject to a stay pending approval of the

United States Environmental Protection Agency (USEPA) of the Board’s rulemaking R94-31,

an amendment to 35 Ill. Adm. Code 218 Subpart T. The amended rule, however, has not

been approved by the USEPA as a revision to the Illinois State Implementation Plan. The

parties request that the stay in this matter be extended until USEPA approval of 35 Ill. Adm.

Code Subpart T, as amended, is published in the Federal Register as a SIP revision.

The motion for stay is granted until March 17, 1997. The parties are directed to file

status reports, either jointly or separately, no later than March 17, 1997.
