    ORDER
    OF
    THE
    BOARD
    (by Mr.
    Goodman):
    On
    April
    28.
    1977,
    the parties
    herein
    submitted a Motion for
    Partial
    Relief
    from Final Order adopted by the Board
    in this matter
    on
    September
    13,
    1976.
    The parties have submitted the Motion pur-
    suant
    to
    Rule
    334
    of the Board’s Procedural Rules based upon newly
    discovered
    evidence
    which
    could
    not
    have
    been
    discovered
    prior
    to
    the
    Board~s
    final
    Order herein.
    Specifically, the parties indicate
    that
    they
    have
    learned
    that
    the
    remaining
    life
    of
    Batteries
    “A”
    and
    “B”,
    upon
    which
    particulate
    control
    devices
    were
    to
    be
    installed,
    are
    foreshortened
    to
    the
    extent that particulate control devices
    could not
    be
    installed
    before
    Battery
    “B”
    would
    be
    out
    of
    service
    and
    Battery
    “A”
    would
    have only a few remaining months of life.
    There-
    fore,
    the
    parties
    seek relief from the requirement of installing
    particulate
    control
    devices on these batteries.
    The parties detail
    in their Motion the specific portions of the Board’s Order from which
    relief
    is
    sought.
    The parties have also submitted,
    as Exhibit
    6 to
    their
    Motion,
    Program Revisions proposed as a substitute for the
    port:Lons
    of
    the Board’s Order from which relief
    is sought.
    The
    Board finds that partial relief from its September 15, 1976,
    Order herein,
    as outlined in the Motion submitted by the parties,
    is
    justified by the
    newly
    discovered
    evidence
    as
    to
    the
    remaining
    life
    of
    Batteries
    “A”
    and
    “B”.
    The Board furthermore finds that adherence
    to the Program Revisions submitted by the parties will adequately en-
    sure compliance with the Environmental Protection Act and the Air
    Reguiations~
    The
    Board,
    therefore,
    grants
    the
    April
    28,
    1977

    submitted by the parties,
    including all modifications requested there-
    in,
    and Orders the parties to comply with all such modifications and
    with the Program Revisions, both of which are incorporated by reference
    as
    if fully set forth herein.
    IT IS SO ORDERED.
