OPINION AND ORDER OF THE BOARD

This matter comes before the Board on a petition for variance
from the requirements of Rule 404(b)
of Chapter
3:
Water Pollution
of the Boardts Rules and Regulations.
A hearing was held on
August 19, 19~7at the City Hall in Henry, Illinois,
The parties
agree that a variance should he granted.
The oniy dispute which
remains is whether the terms of the variance should be tied to the
requirements
of the Federal Water Pollution Control Act Ammendments
of 1972
(FWPCA).
Petitioner operates a chemical plant at Henry,
Illinois, The
wastewater discharge from the plant averages approximately one
million gallons per day and cannot consistently meet effluent
limitations of
20 mg/i BOD and 25 mg/i suspended solids. A number
of short-term remedies have been pursued by Petitioner to get into
compliance, but none of these has performed adequately.
Pre-
sently Petitioner
is confident that construction of an equal-
ization basin at a cost of $46Of 000 will stem the effects of incon-~
sistent influent to its treatment system.
Construction should be
complete by December
1, 1977 and a variance is requested until
May 1,
1978 to allow time to evaluate the improvements.
