BOARD

Zeitlin):
The Board, on Motion of Mr. Zeitlin, hereby proposes and
authorizes for publication the following procedural change to the
Board’s Regulations.
Procedurally, the Proposal recommended in
this Order will require neither public hearings nor an economic
impact study.
Public comment shall be received for a thirty day
period.
Final action will follow the public comment period.
The Proposal
is made to simplify procedures currently existing
under Rule 203(1) (10)
of Chapter
3: Water Pollution,
of the Board’s
Rules and Regulations.
It is felt that the change will not affect
the rights of any possible parties, nor will the requirement of
hearing or the standard for decision
in Rule 203(i) (10)
be affected.
The Proposed Order is as follows:
Rule 203(1) (10) (cc)
is therefore amended to read as follows:
(cc) At an adjudicative hearing, the discharger shall
satisfactorily demonstrate to the Board that the
artificial cooling lake receiving the heated effluent
will be environmentally acceptable, and within the
intent of the Act,
including, but not limited to:
(1)
provision of conditions capable of
supporting shellfish,
fish, and wildlife,
and recreational uses consistent with good
management practices, and
(2)
control of the thermal component of the
discharger’s effluent by a technologically
feasible and economically reasonable method.
