    ORDER OF THE BOARD (by N.J. Melas):
    On December 30, 2002, Kiehl Engineering Co., Inc. (Kiehl) filed a motion to voluntarily
    dismiss this petition for variance. The Board recently approved a stipulation and proposal for
    settlement between Kiehl and the Illinois Environmental Protection Agency on December 19,
    2002, in a related enforcement matter. A condition contained in the stipulation and proposal for
    settlement was that Kiehl must file a motion to voluntarily dismiss this variance petition within
    30 days of the Board’s approval. The Agency has not yet responded. The motion to dismiss is
    granted and this docket is closed.
    IT IS SO ORDERED.
