    ENVIRONMENTAL PROTECTION AGENCY,
    Respondent.
    ORDER OF THE BOARD
    (by Mr.
    Dumelle):
    On December
    6,
1977 Petitioner requested a variance from
    Sections
    12(a)
    and 12(e)
of the Act and Rule 602 of Chapter
    3:
Water Pollution of the Board~sRules and Regulations.
    The
    petition is inadequate
    in several respects.
    First,
    it appears
to request permanent relief which is beyond the Board’s authority
    in variance cases.
    Second,
it. does not comply with Procedural
Rule 401(a) which describes the necessary contents of a variance
    petition.
    Third,
    it fails to
    specifically request or waive a
hearing as required by Procedural Rule 401(b).
    Consequently
    this matter
    is hereby dismissed without prejudice.
    IT IS SO ORDERED.
