ORDER OF THE BOARD

(by Mr. Dumelle):

On November 28, 1977 Petitioner requested a variance from

the requirement of Rule 304 of Chapter

6: Public Water Supplies

for nitrate-nitrogen.

The petition is inadequate

in two respects.

First, it fails to provide a detailed description of Petitioner~s

proposed compliance program, including time schedules and costs,

as required by Procedural Rule 4U1(a) (6).

Second,

it fails to

specifically request or waive

a hearing as required by Procedural

Rule 401(b).

If these deficiencies

are not corrected within 45

days of the date of this Order,

this matter will be subject to

dismissal.
