On July
6, 1977 Petitioner requested a variance.
The petition
is inadequate for failure to comply with the requirements
of Rule 401
of the Board’s Procedural Rules and
is hereby dismissed without
prejudice.
If Petitioner wishes to correct the inadequacies as
listed below it may refile.
The Petitioner failed to state which Board Rules with which it
cannot comply.
It should be noted that the Board lacks jurisdiction
to grant relief from the requirements
of Petitioner’s NPDES permit.
The petition does not describe the locale around the nursing home
nor does it list the number of employees.
No data is supplied
which would indicate the nature of Petitioner’s present effluent
or why the Board’s effluent standards cannot be met.
The time-
table and costs for compliance are not spelled out.
There is no
information on the present and future environmental effects of
Petitioner’s

complying
discharge.

should
be
a
comparison
between the costs of connection to the sanitary sewer and upgrading
of Petitioner’s present facilities.
