ORDER OF THE BOARD
(by Mr. Werner):
On March
27, 1978, the Petitioner requested a Variance from various
provisions of the
Board’s Water Pollution Regulations.
Additional
information is needed to make the Petition for Variance
adequate under
Procedural Rule 401.
The petition
does not include an assessment of environmental impact,
a detailed compliance
program, or reasons why immediate compliance with
the regulations
would impose an arbitrary or unreasonable hardship.
The
period of time for
which relief is sought is not specified, and a full
description of the
nature and quantity of the discharges
(as well as past
and proposed control
methods)
is not given.
Moreover, the
petition fails
to specifically request or waive
a
hearing as required
by Procedural Rule 401(b).
It is the
Order of the Board that Petitioner shall amend the variance
petition within
45
days of the date of this Order.
Failure to timely file
an amended petition
shall cause the petition to be denied without
prejudice for
inadequacy.
