ORDER OF THE BOARD (by R.C. Flemal):
On November 24, 1999, petitioner, The C.P. Hall Company (C.P. Hall), filed a motion for consolidation of two
variance petitions, PCB 00-53 and PCB 00-54, for the limited purpose of hearing. The petitions address operations at
the same facility and seek identical relief from related provisions of the Board’s regulations. The main substantive
difference between the two petitions is that PCB 00-53 covers one specific condenser and PCB 00-54 covers all batch
operations. C.P. Hall indicates that the Illinois Environmental Protection Agency supports consolidation.
Pursuant to 35 Ill. Adm. Code 103.141, the Board may consolidate variances in the interest of a convenient,
expeditious and complete determination of claims. The Board finds that these interests are present in the instant
matter, and accordingly grants the motion to consolidate the two variance petitions for the purpose of hearing. The
caption reflects today’s ruling.
