    (by Mr. Dumelle):
    On February 3,
    1978 Petitioner requested a variance
    from
    the Board’s Air Pollution Control Regulations.
    A compliance
    date of December 1980 is contemplated
    in the Petition.
    This
    appears to conflict with Section 113(d) (1) (D)
    of the Clean Air
    Act and may be beyond the Board~sauthority.
    If Petitioner does
    not address this problem within 45 days of the date of this
    Order and show how it will comply with the Clean Air Act, this
    matter will be subject to dismissal.
    IT IS SO ORDERED.
