DISSENTING OPINION (by W.A. Marovitz):
I respectfully dissent from the Board’s opinion and order issued today. I disagree with
the assessed penalty.
I believe that the $3,000 penalty will not serve to deter further violations of the Act by
respondent. Respondent made no attempts to comply with the Act after this complaint was filed.
Respondent also showed a total disregard for the residents of the surrounding community. I
believe a higher penalty against respondent is appropriate.
For these reasons, I respectfully dissent.
