 The
waters
 of
 the
 o~et~tBranch
 enter
 the
 Scattering
 Fork
 and
 via
the
 Embarras
 River
 empties
 into
 Lake Charleston
 in
 Coles
 County,
Illinois.
 Since
 toe
 treatment
 plant
 discharges
 to
 a
 lake,
 it
is
 subject
 to
 the
 i:uquarement.s
 of
 Rules
 203(c)
 and
 402
 for
phosphorus
 which,
 in
 combination,
 prohibit
 any
 discharge
 from
causing or
 contributing
 to
 a
 violation
 of
 the
 0.05
 mg/i
 phos-
phorus water quality
 standard
 in any lake
 or
 in
 any
 stream
 at
the
 point of entry
 into the
 lake.
 Petitioner,
 however,
 does
not
 need
 a
 variance
 from
 Rule
 404(f)
 for,
 in
 this
 case,
 relief
from
 Rule
 203 (c)
 would
 remove
 the
 phosphorus
 standard
 as
 a
condition
 for
 a
 Pfeffer
 exemption.
The
 Tolono
 sewace treatment plant consists of a bar
screen
and comminutor,
 lift
 station,
 twin
 aeration
 tanks,
 twin
 clan—
fiers, two sludge diqestors,
 lagoon,
 chlorine detention
tank
and sludge drying beds,
 Recently,
 Petitioner has
received
a
Step
 I facilities
 pie
 minq
 grant for upgrading the treatment
facility.
 Anticipatec improvements
 following approval
of
Step
 II and Step III grants include nitrification,
 tertiary
filtration, acquisition
 of
 u~uxiliarypower equipment
 and sludge
application
 and
 maintenance equipment
 (Pet.

of judicial review of this

the Environmental Protection Act.
