This Order comes in response to Petitioner’s Motion

for Modification

filed June

12,

1978, and the Response

of

the

Environmental Protection Agency dated June 15,

1978.

The pleadings indicate that Petitioner’s expansion

of its sewage treatment plant has been completed and the

Agency has issued an NPDES permit

to operate at the

expanded capacity.

Based upon this showing of substantial

compliance,

the Board finds that jurisdiction retained

in this matter pursuant to Board Orders of September

15,

1977, and November 10, 1977,

is no longer necessary.

The restrictions contained

in suh-paraqrnphs

3(c)(as)

amended),

3(d),

3(e),

3(f)

and

3(q) will have no

force

and

effect from the date of this Order.
