ORDER OF THE BOARD
(by Mr. Dumelle):
On April
24, 1978 Petitioner requested a variance from
the Board’s Air Pollution Control Regulations so that its
foundry in Rockford could be allowed
to continue operating,
The Petition is insufficient in several respects.
First
it
fails to specifically identify the Board regulations from
which relief
is sought as required by Procedural Rule 401(a) (1).
Second it does not state the reasons why compliance was not
achieved by the required date as required by Procedural Rule
401(a) (5).
Third it fails to assess the environmental impact
of the requested relief as required by Procedural
Rule 401(a) (7).
Fourth it fails to specifically request or waive a hearing as
required by Procedural Rule 401(b),
Additionally
it fails to
state any reason why the Board should extend ultimate compliance
beyond July
1,
1979,
the date mandated under Section 113 of the
Clean Air Act.
If these inadequacies are not corrected within
45 days of the date of this Order,
this matter will be subject
to dismissal.
