ORDER OF THE BOARD (by Mr. Dumelle):
It is the Order of the Pollution Control Board that
1)
the original Petitioner, Village of Bloomingdale,
and each of the joined parties be granted a variance
from Chapter 3, Rules 203(d) and 402 as they apply
to dissolved oxygen, and Rules 962(a) and 902(i) (1)
as they relate to conformance with the Board’s
dissolved oxygen water quality standards for a
period of five years;
2) the original Petitioner, Village of Bloomingdale,
and each of the. joined parties that is subject~to
Chapter 3, Rule 404(f), be granted a variance from
Rule 404(f) so as to be allowed to discharge up to
a 10 mg/i BOD and 12 mg/L suspended solids standard
for a period, of five years or until a final decision
is reached in R77—12, Docket C, whichever occurs first;
3) the original Petitioner, Village of Bloomingdale,
be denied a variance from Rules 203(f) and 402 of
Chapter 3 as they relate to ammonia nitrogen, for
its proposed interim expansion of its sewage treat-
ment plant;
4) the Agency, pursuant to Rule 914 of Chapter 3, shall
reissue NPDES permits to the original Petitioner,
village of Bloomingdale, and each of the joined parties,
consistent with this Order including such effluent
limitations as may reasonably be achieved through
application of best practicable operation and mainten-
ance practices in their respective facilities; and
5) this ~variance does not apply to any discharger who, by
virtue of a prior variance or NPDES permit is present-
ly allowed to discharge at a level in excess of
10 mg/i
SOD and 12 mg/i suspended solids.
