1978 Petitioner requested a variance

from Section 39 of the Act as that Section pertains to the

emissions from Petitioner’s tripolyphosphate facilities.

The

Petition

is deficient in several respects.

First,

it fails

to describe the nature and extent of Petitioner’s failure to

meet the Board’s standards as required by Procedural Rule

401(a) (5).

Second, it fails to describe a control program

which will result in compliance with Board standards as

required by Procedural Rule

.401 (a) (6).

Third, it fails

to

specifically request or waive a hearing as required by Proce-

dural Rule 401(b).

Consequently, this matter is hereby

dismissed.
