ORDER OF THE BOARD (by Mr. Goodman):
On August 18, 1978, Respondent Watts Trucking Service, Inc.,
(Watts) filed an Application for Non-Disclosure requesting that
financial records documents submitted by Watts be kept confiden-
tial. On August 23, 1978, the Environmental Protection Agency
(Agency) filed an Opposition to Application for Non—Disclosure
and Motion to Compel.
The ~oard hereby grants the Application for Non-Disclosure
and orders that the materials submitted by Watts with its
Application be stamped “Not Subject to Disclosure.” However,
the Board also grants the Agency’s Motion to Compel and orders
that Watts answer Interrogatory No. 14 and produce for the Agency
and its counsel the documents identified in the answers to
Interrogatories No. 34 and No. 35 within 14 days of this Order.
The Board furthermore orders that the materials stamped “Not
Subject to Disclosure” be disclosed to the Agency and its counsel
when necessary in the preparation of their case.
