On August 15,

1978 Petitioner filed a Second Amended Petition

for Variance in this matter.

The Petition is insufficient in the

following respects.

First,

it fails

to describe any program which

will result in full compliance with the Act and the Board’s Air

Pollution Control Regulations.

Second it fails

to show compliance

with Section 113(d)

of the Clean Air Act as amended in 1977

as

required by a recent amendment to Section

35 of the Act

(Public

Act #80—1299).

Consequently this matter is hereby dismissed.
