On the motion of several interested parties,

the Board

hereby orders that a public hearing be held in this matter.

At

the hearing the burden of proof

shall lie with the Waukegan Port

District to prove that the requested activity shall not cause

water pollution as that term is defined in Section 3(n)

of the

Environmental Protection Act.
