    ORDER OF THE BOARD
    (by Dr. Satchell):
    It is the Order of the Pollution Control Board that Homer
    Grain Company is granted a variance from Rule 203(d) (9) (B)
    of
    Chapter
    2:
    Air Pollution Control Regulations
    for its Homer,
    Illinois,
    facility, subject to the following conditions:
    1.
    The Petitioner shall install an emission control system
    on dump pits B-i and B-3 as described in the construction
    permit application submitted to the Agency on August 21,
    1978,
    and Appendix D of the variance petition in accord-
    ance with the schedule set forth in paragraph
    9 of the
    petition.
    The Petitioner shall begin operation of the
    emission control system for dump pits B-i and B-3 by
    June
    30,
    1979.
    2.
    The Petitioner shall install an emission control system
    on the dry grain conveyor system designated Conveyor D—l
    as described in the construction permit application
    submitted to the Agency on August
    21,
    1978 in accordance
    with the schedule set forth in paragraph
    9 of the
    petition.
    The Petitioner shall begin operation of the
    emission control system for Conveyor D-1 by June 30,
    1979.
    3.
    The Petitioner shall install an emission control system
    for the railroad load—out process
    as described in the
    construction permit application submitted to the Agency
    on August 21,
    1978
    in accordance with the schedule set
    forth in paragraph
    9 of the petition.
    The Petitioner
    shall begin operation of the emission control system for
    the railroad load-out process by October
    31, 1978.
    4.
    The Petitioner shall test the control efficiency of
    the workhouse cyclones.
    If the results of the test
    show the equipment
    is inadequate to meet the require-
    ments of Rule 203(d) (9) the Petitioner shall submit

    a construction permit application for an emission
    control system to replace these cyclones.
    The emission
    control system shall achieve compliance no later than
    June
    30, 1979.
    5.
    The Petitioner shall submit to the Agency reports on
    the progress of construction certifying whether the
    interim compliance steps set forth in paragraph 9 of
    the variance petition have been met in a timely manner.
    A report shall be submitted within five days after each
    of the following dates:
    January
    1,
    1979; April
    1,
    1979;
    July
    1,
    1979.
    Also Petitioner shall make an annual verifi-
    cation to the Agency of the through-put of dump pit B-2.
    6.
    Within forty—five days of the date of this Order,
    Petitioner shall execute and forward to the Illinois
    Environmental Protection Agency, Variance Section,
    2200 Churchill Road, Springfield,
    Illinois 62706, a
    Certificate of Acceptance and Agreement to be bound
    to all terms and conditions of this variance.
    This
    fonty-five day period shall be held in abeyance for any
    period this matter is being appealed.
    The form of the
    Certificate shall be
    as follows:

    having read
    and fully understanding the Order in PCB 78-184, hereby accept
    that Order and agree to be bound by all of its terms and condi-
    tions.

    7.
    Final compliance must be achieved by July

    1979,
    or
    Homer Grain will be subject to noncompliance penalties
    under Section
    120 of the Clean Air Act as amended in
    August,
    1977
    (42 U.S.C.
    7401 et seq.).
