Environmental Protection Agency filed
a Motion
to dismiss
the instant variance proceeding because
the Pet-
itioner, Matthiessen
& Hegeler,
is now out
of
business,
the plant
in
question is comeletely shut down,
and all
the
assets of the corpora-
tion are now in the hands of
a Receiver.
The Agency submitted an
Affidavit supporting
its allegations as to Petitioner’s
status.
No
response to
the Agency’s Motion has been
f:i~led.
Based upon the information supplied by the Agency, we find
there
is no longer sufficient reason to issue
a variance.
The Peti-
tion for Variance is hereby dismissed.
