ORDER OF THE BOARD

(by Mr. Dumelle):

On March

22, 1979 Petitioner moved the Board to modify

its

Order in this case dated April

13,

1978 and requested an

extension of the variance granted in that Order.

Petitioner

requested an extension until October 31, 1980 to complete

the construction needed to comply with the former iron and

manganese standards of Rule 304 B

4 of Chapter

6:

Public

Water Supplies.

On March

1,

1979 the Board adopted R77—13 which contained

amendments

to Rule 304 B

4 of Chapter

6 which relaxed the

standards for iron and manganese and extended the date for

compliance with these standards until July

1,

1981.

The

Board’s regulatory decision to extend the compliance date

has eliminated the need for any further relief in this

matter and has nullified the terms and conditions of the

Order entered in this matter on April

13,

1978.

Consequently

the motion for modification

is hereby denied and the petition

for an extension

is hereby dismissed.
