On September 21, 1979 the Hearing Officer in this and the
related proceedings PCB 78—247 and PCB 79—114 filed a motion
for authority to set hearing dates and related matters.
The
Hearing Officer’s authority under Procedural Rules
307,
311
and 408 will soon expire~andadditional time for discovery
is
needed.
The parties anticipate that they will be ready for a
hearing in January or February, 1980.
The Petitioner has waived
its right to decision under §38 of the Environmental Protection
Act through October
30, 1979.
The motion sets forth that the
Petitioner has indicated that a further waiver will be forth-
coming.
On September 24,
1979 the Environmental Protection
Agency filed a response indicating no objection.
The motion is granted.
The Hearing Officer shall have
authority to permit additional discovery, grant continuances
and set hearings through March
1, 1980.
