ORDER OF THE BOARD
(by Mr. Dumelle):
On February 26,
1979 Petitioner requested a variance from
the water quality standards for sulfate and total dissolved
solids in Rule
203(f) of Chapter
3: Water Pollution of the Board’s
Rules and Regulations.
The Petition is deficient in two respects.
First,
it fails to describe the length of time for which
a
variance
is needed as required by Procedural Rule 401(a) (1).
Second,
it
fails
to describe a program whereby Petitioner will
come into compliance with the water quality standards as required
by Procedural Rule 401(a) (6).
If these inadequacies are not
corrected within 45 days of the date of this Order, this matter
will be subject to dismissal.
The statutory 90 day decision
period shall run from the date an amended petition is filed.
