On February 16,
1979, Beling Consultants filed on behalf
of Bradley Heights Water System
a petition for variance from
Rule 305 of Chapter
6 and from Technical Policy Statement
212(E)
(2).
The Petition does not fulfill the requirments of
Rule 401 of the Procedural Rules
in the following respects:
it contains no compliance plan, cost of achieving compliance,
or time schedule for compliance,
and it does not include any
statement explaining
if or why compliance with the regulations
from which variance
is sought would impose an arbitrary and
unreasonable hardship.
The Petition
is dismissed without
prejudice.
The Agency on February 26,
1979, filed a Motion to
Dismiss.
That Motion is now moot and is hereby dismissed.
