ENVIRONMENTAL PROTECTION AGENCY,
Respondent,
ORDER OF THE BOARD
(by Mr. Goodman):
On February 14,
1979,
the Environmental Protection Agency
(Agency) filed a Motion for Specification of Errors requesting the
Board to order General Motors Corp.
(GM)
to specify the errors upon
which it relies,
In the alternative,
the Agency requests that the
Board deny a hearing herein and decide this matter solely on the
Agency~srecord,
GM filed a Motion to Deny Specification of Errors
on February 23,
1979.
The Board finds that GM has in sufficient detail specified the
errors on which it relies,
In addition,
the Board finds that, pur-
suant to the Environmental Protection Act and the Procedural Rules,
Petitioner
is entitled to a hearing on its Petition.
The Motion for
Specification of Errors
is hereby denied.
Having denied the Agency~smotion,
the Board finds that GM’s
Motion to Deny,
filed February
23,
1979,
is moot.
The Motion to
Deny is dismissed.
IT IS SO ORDERED.
